Unless otherwise defined in this Policy, all capitalized terms have the same meaning as in Moonlight Counselling’s Terms of Service. 

This Policy describes how Grace Debassige dba Moonlight Counselling (“Moonlight Counselling” or “we”)  collect, use, disclose, and protect the personal information of our clients and users in the course of providing the Services, and applies to personal information we collect, use, or disclose about you:

  1. through the Website;
  2. in email, text, and other electronic messages between you and Moonlight Counselling; and
  3. through the Services.

This Policy does not apply to the collection, use, disclosure and protection of your personal information by third-party websites, External Platforms, plug-ins, services, or applications which you access through the Website or in the course of the Services.

In this Policy, “personal information” means any information that can reasonably be used to identify you, either by itself or when combined with information available from other sources. “Personal health information” means information that relates to your physical health or any health service provided to you, unless otherwise defined in applicable law. 

By using the Website, Services, or otherwise submitting personal information to Moonlight Counselling, you consent to Moonlight Counselling’s collection, use, and disclosure of your personal information in accordance with this Policy. You may refuse or withdraw your consent to certain practices described in this Policy by contacting grace@moonlightcounselling.net or by following the instructions below, but this may impact our ability to provide you with the Services.

This Policy may be updated from time to time. Your continued use of this Website after we make changes indicates that you accept and consent to those changes, so please check periodically for updates.

Information We Collect 

We may collect and use several types of information from and about you, depending on which Services you use. We only collect the information necessary to provide the Services and operate the Website and our business. 

If you access the Website, we may collect:

  1. Technical information, including your browser type, time zone, operating system, IP address and device type; and
  2. Personal information including your name, email address, and phone number if you submit this information to us by email, through our contact form, or sign up for our newsletter.

If you purchase a Course or register for an Event, we may collect:

  • Your name, address, phone number, and email address; and
  • Your account name on LearnDash.

We do not collect your credit card information when you purchase a Course or register for an Event.  Your payment will be processed through a third-party provider that complies with PCI DSS standards.  

When you use an External Platform to access the Courses or an Event, you will also be subject to its privacy policy. LearnDash’s privacy policy is available here.

If you use the Counselling Services, we may collect:

  • Your name, address, email address, and phone number;
  • If you have are paying through an insurance provider, your insurance information;
  • Your medical history and other personal health information and personal details;
  • Videos and sound recordings containing your likeness and voice (these recordings will not be stored); 
  • The name and phone number of an emergency contact person; and
  • If you were referred to us, the name of the person who referred you.

The Counselling Services are confidential.  Moonlight Counselling does not store or retain any videos or sound recordings of remote sessions.  All video sessions are encrypted and run through Canadian servers.  

The information you disclose during the Counselling Services will not be shared with anyone unless you consent or Moonlight Counselling has a legal obligation to disclose certain information.  If Moonlight Counselling believes that there is an imminent risk to you or someone else, we are required by law to inform the appropriate authorities. 

When you use an External Platform to access the Counselling Services, you will also be subject to its privacy policy. OwlPractice’s privacy policy is available here.

How We Use Your Information

We use information that we collect from you, including personal information and health information:

  1. To operate, improve, and analyze information about our Website;
  2. To provide you with the Services;
  3. To provide you with information or support that you request from us;
  4. To carry out our obligations and enforce our rights arising from any contracts with you, including for billing and collection or to comply with legal requirements;
  1. To notify you about changes to our Website or any Services we offer or provide through it;
  2. To keep the Services secure;
  3. To improve our Services, marketing, or customer service;
  4. In any other way we may describe in this Policy or when you provide the information; and
  5. For any other purpose with your consent.

Who We Disclose Your Personal Information To

We may disclose personal information that we collect about you:

  1. To contractors, service providers, and other third parties that support our business (such as External Platforms, Website hosting providers, and payment processors);
  2. To comply with any court order, law, or legal process, including government or regulatory requests;
  3. To enforce or apply our Terms of Service and other agreements, including for billing and collection purposes;
  1. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Moonlight Counselling, our customers, or others; 
  2. As otherwise permitted by applicable laws; and
  3. With your consent.

Your personal health information will be stored in Canada. However, in accordance with this Policy, we may disclose other personal information to External Platforms and third-parties or service providers in other provinces or foreign countries, where it may be processed, stored, or transferred to a foreign country, with different privacy laws.  By submitting your personal information, including personal health information, to Moonlight Counselling, you consent to this transfer, storage, and processing.

How To Manage the Collection of Your Personal Information

You have choices when it comes to certain information that we collect from you. The mechanisms you can use to manage the collection of your personal information are described below: 

Automated Data Collection

When you visit the Website, our hosting provider automatically collects certain information about your visit, such as your browser type, language preference, IP address, referring site, and the date and time of each visit.  You can find WordPress’ privacy policy here. This information is primarily collected through “cookies”, small files placed on your computer that collect standard log information.

You can adjust your browser settings to refuse all or some browser cookies. If you disable or refuse cookies, some parts of this Website or the Services may not be accessible or may not function properly. 

Newsletters and Promotional Offers 

If you subscribe to our newsletter, we will use your personal information to contact you about Services, updates, promotions, and other information that may be of interest to you. If you no longer wish to receive this information, you may withdraw your consent at any time by using the unsubscribe mechanism at the bottom of our emails. 

If you unsubscribe to our newsletter, we will continue sending you information that is directly related to your use of the Services, such as appointment reminders. 

How We Keep Your Information Secure

We use physical, electronic, and administrative measures to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We have contracted with reputable third-parties like OwlPractice and LearnDash to securely process and store the information you provide to us.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, the transmission of information online is not completely secure, and we cannot guarantee the security of your personal information when you submit it through the Website or an External Platform. Any transmission of personal information is at your own risk. 

How We Retain Your Data

Unless otherwise permitted or required by applicable law, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including to satisfy any legal, accounting, or reporting requirements. 

Use of the Website By Children

Our Website is not intended for children; however, parents and legal guardians may use the Website and the Counselling Services on behalf of their dependents.  

Your Rights

Access and Correction

You have the right to access the personal information we maintain about you and correct it if it is inaccurate.

To review, verify, or correct your personal information, please contact grace@moonlightcounselling.net. We may request specific information from you to confirm your identity and to provide you with the personal information that we hold about you or make your requested changes. 

If we believe a requested change would violate any law or cause your information to be incorrect, we may refuse your request. We may also refuse access to certain information, as permitted by applicable law (e.g. information protected by solicitor-client privilege). If we cannot provide you with access to your personal information, we will tell you why, subject to any legal or regulatory restrictions.

Deletion and Withdrawal of Consent

You have the right to withdraw your consent to our collection and use of your personal information or request that we delete your personal information. If you withdraw your consent or request that we delete your information, we may not be able to provide you with some or all of the Services. =

To withdraw your consent or request deletion of your personal information, please contact  grace@moonlightcounselling.net. We may request specific information from you to confirm your identity and identify the personal information we hold about you. 

If we believe that withdrawing your consent or deleting your information is contrary to law, we may refuse your request and explain our decision to do so, subject to any legal or regulatory restrictions.

Notification of Breach

You have the right to know if there has been a breach in the security of your personal information, and that breach creates a real risk of significant harm to you.

If your information is compromised and it creates a real risk of significant harm, we will notify you in accordance with applicable law, and take all reasonable steps to minimize the impact of the breach.
